These Terms of Service (the “Terms”) govern your access to and use of the website at www.fusewise.com and its sub-domains (the “Website”), operated by Fusewise AG (“Fusewise”, “we”, “us” or “our”), Kurhausstrasse 8, 8703 Erlenbach, Switzerland. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
Relationship to our Services. The Website is an informational website. Access to and use of the Fusewise platform and related services (the “Services”) is governed by a separate written agreement between Fusewise and the relevant customer (the Master Services Agreement, its Data Processing Agreement and potentially additional agreements), and not by these Terms. Nothing in these Terms grants any right to access or use the Services, and in the event of any conflict regarding the Services, that separate agreement prevails.
1. Acceptance of and changes to these Terms
By accessing or using the Website you confirm that you accept these Terms and agree to comply with them. We may update or amend these Terms from time to time, for example to reflect changes to the Website or to legal requirements. The version published on the Website applies, and your continued use of the Website after any change constitutes acceptance of the amended Terms. Please check this page periodically; the date at the end indicates when these Terms were last updated.
2. Who may use the Website
The Website is intended for business users and for general information about Fusewise and its Services. It is not directed to children, and we do not knowingly collect data relating to children through the Website. By using the Website you confirm that you are at least 18 years old and, where you act on behalf of an organisation, that you are authorised to do so.

To the maximum extent permitted by applicable law, Fusewise shall not be liable for any loss or damage arising out of or in connection with your access to, use of, or inability to use the Website, or any reliance on its content, including any indirect, incidental or consequential loss, loss of profit, data or goodwill. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Swiss law, in particular liability for unlawful intent or gross negligence, or for death or personal injury caused by negligence.

We may change, suspend, restrict or discontinue all or part of the Website at any time, with or without notice, and we are not obliged to keep the Website or any content up to date. We may also restrict your access to the Website if we reasonably believe you have breached these Terms or applicable law.
11. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Website, are governed by the substantive laws of Switzerland, excluding its conflict-of-laws rules and international treaties (including the Vienna Convention on the International Sale of Goods; CISG). The exclusive place of jurisdiction is the City of Zurich, Switzerland, subject to any mandatory statutory place of jurisdiction.
12. General
These Terms constitute the entire agreement between you and Fusewise in relation to your use of the Website. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary and the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights or obligations under these Terms without our consent; we may assign these Terms in connection with a reorganisation or sale of our business. These Terms do not create any partnership, agency or employment relationship between you and Fusewise.
